Terms of Service

By accessing or using Agentivo.MY, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, please discontinue use immediately. These Terms constitute a legally binding agreement between you and Baloot MY Digital Agency.

To use Agentivo.MY, you must:

• Be at least 18 years of age
• Hold a valid insurance agent license in Malaysia, or be actively pursuing one
• Have the legal capacity to enter into binding agreements under Malaysian law
• Not be prohibited from using the platform under any applicable Malaysian law or regulation

Agentivo.MY is a Software-as-a-Service (SaaS) business management platform designed to assist licensed insurance agents in Malaysia with lead management, policy tracking, commission monitoring, and team coordination.

Agentivo.MY offers AI-powered features including Needs Analysis, AI Policy Explainer, and AI Caption Generator. By using these features, you expressly acknowledge and agree that:

• All AI-generated outputs are for reference and assistance purposes only
• AI outputs do NOT constitute licensed financial advice, insurance advice, or professional recommendations
• You MUST independently verify all AI-generated content with the relevant insurance company before presenting it to clients
• AI data may not reflect the most current products, rates, premiums, or regulatory requirements as of the date of use
• Agentivo.MY and Baloot MY Digital Agency shall not be liable for any loss, damage, complaint, or regulatory action arising from your reliance on AI-generated content
• You use AI features entirely at your own risk

You agree NOT to use Agentivo.MY to:

• Violate any applicable Malaysian law or regulation
• Upload false, fraudulent, or misleading client data
• Impersonate another person, entity, or Agentivo.MY staff
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or attempt to extract source code from the platform
• Resell, sublicense, or transfer your account access to third parties
• Use AI features to generate or distribute misleading financial or insurance advice
• Engage in any activity that disrupts or interferes with platform services

If you subscribe to the Team Plan and use the Invite Code feature:

• You are responsible for ensuring all agents you invite comply with these Terms
• You are responsible for the appropriate use of team features including Broadcast and Leaderboard
• Agentivo.MY is not liable for any misuse of Invite Codes or team features by agents under your account
• Team Leaders must not invite agents to circumvent individual subscription requirements

All content, design, code, trademarks, and materials on Agentivo.MY are the exclusive property of Baloot MY Digital Agency. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the platform without express written permission.

• You retain full ownership of all data you input into the platform (leads, policies, client information, etc.)
• By using the platform, you grant Baloot MY Digital Agency a limited, non-exclusive license to process your data solely for the purpose of providing the service
• Upon account termination, your data will be retained for 90 days and then permanently deleted, unless deletion is requested earlier

By enabling push notifications, you consent to receiving service-related notifications from Agentivo.MY including renewal alerts, system announcements, and account updates. Agentivo.MY will not use push notifications for third-party advertising purposes. You may opt out at any time via Dashboard > Settings > Notifications.

To the maximum extent permitted by Malaysian law:

• Baloot MY Digital Agency's total aggregate liability to you shall not exceed the total subscription fees paid by you in the three (3) months immediately preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for loss of profits, loss of data, business interruption, or reputational damage
• We are not liable for losses arising from platform downtime, third-party service failures, data loss, or AI output errors

You agree to indemnify, defend, and hold harmless Baloot MY Digital Agency and its directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from:

• Your use of or inability to use Agentivo.MY
• Your violation of these Terms
• Any advice, recommendations, or services you provide to your insurance clients
• Any breach of applicable laws or regulations in connection with your use of the platform

We strive to maintain platform availability but do not guarantee uninterrupted access. Agentivo.MY may be unavailable due to scheduled maintenance, technical issues, or circumstances beyond our control. We are not liable for any losses arising from platform unavailability.

We reserve the right to update these Terms at any time. For material changes, we will notify you via email at least 30 days before the new Terms take effect. Continued use of the platform after the effective date constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.

• These Terms are governed exclusively by the laws of Malaysia
• Any dispute arising from these Terms or your use of Agentivo.MY shall be submitted to the exclusive jurisdiction of the courts of Malaysia
• You agree to first attempt to resolve any dispute informally by contacting hello@agentivo.my before initiating legal proceedings

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, Refund Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Baloot MY Digital Agency regarding your use of Agentivo.MY.
